What standard does the court use in deciding custody?

In North Carolina, the judge decides all custody issues based on what the judge concludes will promote the best interests and welfare of the minor child. Neither parent is presumed to be better able to promote the best interest of the child. In fact, in North Carolina, until a court makes a custody decision or the parties reach agreement, both parents have equal rights to the child. The key is the best interest of the child – not what is convenient or better for the parent.
